FAUSTINA® Affiliate Program Agreement

This Affiliate Program Agreement (“Agreement”) governs participation in the FAUSTINA® Affiliate Program operated by LaboTest Ltd through the FAUSTINA® Skin Innovation Online Store (“FAUSTINA”, “Company”, “we”, “us” or “our”). By applying for or participating in the Affiliate Program, you (“Affiliate”, “you” or “your”) agree to the terms below.

1. Eligibility and Acceptance

You must be at least 18 years old and legally able to enter into this Agreement. Submission of an affiliate application does not guarantee acceptance. We may approve or reject an application at our discretion and may request additional information before approving an account.

2. Independent Relationship

Your participation does not create an employment, partnership, joint venture, agency or franchise relationship. You participate as an independent affiliate and are responsible for your own taxes, expenses and legal obligations.

3. Affiliate Links and Tracking

Approved affiliates receive individual tracking links or other approved referral methods. You must use the tracking links supplied through the FAUSTINA Affiliate Portal or otherwise approved by us. Commissions can only be credited where the referral is correctly tracked and can reasonably be attributed to your affiliate account.

You must not manipulate tracking systems, cookies, referral URLs, customer devices or attribution methods in order to obtain commissions that would not otherwise have been earned.

4. Commission Rates

Commission is calculated according to the affiliate rank assigned to your account at the time a qualifying referral is credited. Current commission levels are:

  • Beginner: 7.5%
  • Basic: 10%
  • Premium: 12.5%
  • Experts: 15%

Your applicable commission rate is shown in your Affiliate Portal. Rank assignment and commission rates may be reviewed or changed by the Company. Any change will apply in accordance with the program settings in force at the relevant time.

5. Qualifying Purchases

A commission may be earned when a customer follows a valid affiliate referral and completes a qualifying purchase from FAUSTINA. A purchase will not qualify, or a commission may be cancelled or adjusted, where the transaction is fraudulent, cancelled, refunded, charged back, duplicated, incorrectly tracked, made in breach of this Agreement, or otherwise not considered a valid completed sale.

Self-referrals, artificial transactions, misleading referrals and transactions created primarily for the purpose of generating affiliate commission are not permitted unless expressly authorised by us.

6. Coupons and Promotional Codes

Affiliates may promote coupon or promotional codes that have been issued or expressly authorised by FAUSTINA for their use. Affiliates must not create, advertise or distribute unauthorised discount codes or represent that an unauthorised discount is available from FAUSTINA.

7. Payouts

Affiliate balances are maintained in GBP. The default affiliate payout method is bank transfer.

Commissions are subject to a 30-day grace period before becoming eligible for payout so that transactions can be checked for cancellations, refunds, chargebacks, fraud or other adjustments.

There is currently no minimum payout amount configured in the Affiliate Program. We may request reasonable payment, identity, tax or banking information before issuing a payment.

The Affiliate is responsible for providing accurate payment information. We are not responsible for delays or losses caused by incorrect information supplied by the Affiliate.

8. Returns, Refunds and Chargebacks

If a purchase on which commission was recorded is subsequently cancelled, refunded, reversed or charged back, the corresponding affiliate commission may be cancelled, deducted from an unpaid balance or adjusted against future commissions.

9. Advertising and Disclosure

You must clearly disclose your affiliate relationship wherever required by applicable advertising, consumer-protection or endorsement rules. Affiliate promotions must be honest, accurate and not misleading.

You must not make medical, clinical, performance or product claims about FAUSTINA products that have not been authorised or supported by information supplied by FAUSTINA.

10. Prohibited Promotion

You must not promote FAUSTINA through unlawful, fraudulent, deceptive, defamatory, obscene or discriminatory material. You must not use spam, unsolicited bulk communications, malicious software, misleading redirects or other abusive promotional methods.

You must not impersonate FAUSTINA, LaboTest Ltd or any member of our staff, and you must not suggest that your website, social-media account or advertisement is an official FAUSTINA channel unless we have expressly authorised it.

11. Intellectual Property

While you remain an approved Affiliate, we grant you a limited, non-exclusive, revocable and non-transferable permission to use approved FAUSTINA trademarks, product images, banners and promotional materials solely for participation in the Affiliate Program.

You may not alter our trademarks in a misleading manner, register domains or accounts intended to impersonate FAUSTINA, or use our intellectual property in a way that causes confusion about ownership or endorsement.

12. Affiliate Content and Websites

You are responsible for your own websites, social-media accounts, advertisements and other promotional channels. You must ensure that your content complies with applicable laws, platform rules, privacy requirements and intellectual-property rights.

13. Data Protection

You are responsible for complying with applicable privacy and data-protection laws in relation to information you collect or process through your own promotional activities. You must not obtain or use customer personal information from FAUSTINA except where expressly authorised and legally permitted.

14. Monitoring and Fraud Prevention

We may review affiliate activity, referral patterns, transactions and promotional methods for program administration, fraud prevention and compliance. We may withhold or investigate commissions where activity appears irregular or inconsistent with this Agreement.

15. Suspension and Termination

Either party may end the affiliate relationship. We may suspend or terminate an affiliate account immediately where we reasonably believe there has been fraud, abuse, misleading promotion, unlawful conduct, misuse of our intellectual property, manipulation of tracking, or another material breach of this Agreement.

Valid commissions earned before termination may remain payable subject to verification, the applicable grace period and any adjustments for refunds, reversals or breaches of this Agreement.

16. Changes to the Program

We may update the Affiliate Program, commission structure, payout arrangements, promotional rules or this Agreement from time to time. Updated terms will apply from the stated effective date. Continued participation after an update constitutes acceptance of the revised terms.

17. Availability of the Affiliate Program

We do not guarantee uninterrupted availability of the Affiliate Portal, tracking technology or related services. Temporary technical interruptions may occur due to maintenance, updates or circumstances outside our reasonable control.

18. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for indirect or consequential losses arising solely from participation in the Affiliate Program, including loss of anticipated commission caused by tracking failures, third-party services or circumstances outside our reasonable control. Nothing in this Agreement excludes liability that cannot lawfully be excluded.

19. Governing Law

This Agreement and the Affiliate Program are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction over disputes arising from or relating to this Agreement, subject to any rights that cannot lawfully be excluded.

20. Entire Agreement

This Agreement, together with other applicable terms and policies published on the FAUSTINA website, constitutes the agreement governing participation in the Affiliate Program and supersedes previous affiliate terms relating to participation through the former LaboTest website.
